According to the Union Home Ministry's updated Immigration and Foreigners Rules, 2025, foreigners wishing to stay in India longer than their allowed visa period must now register earlier. Visitors with visas of 180 days or less are now required to finish the registration process before the 180-day period expires.
After 180 days of arrival in India, eligible foreign nationals could finish registration within 14 days under the former system.Rule 12 of the Immigration and Foreigners Rules, 2025 has been amended, according to a notification released on Monday. The requirement to register "within 14 days after expiry of 180 of his arrival in India" has been replaced with a new requirement that requires registration "any time before expiry of said period of 180 days."
These visa holders will now need to finish registration before the 180-day term expires if they plan to stay in India longer than the allotted 180 days, either on a single occasion or over the course of a calendar year.
Additionally, the government has made it clear that authorisation for such prolonged stays will only be given in "emergent circumstances," limiting the scope of approvals that go beyond the allotted time.
RELIEF FOR FOREIGN NATIONALS' CHILDREN
The updated regulations also offer relief in situations where children born in India to parents who are either foreign nationals or both.In the past, in order to obtain visa-related services, such as the granting of a new visa or exit permit, parents had to electronically notify the registration officer using the designated web portal or mobile application within 30 days after the child's birth.
Cases when one of the parents is an Indian citizen and wants to keep the child's Indian citizenship are exempt from the new notification.
The statutory reporting obligation after birth will no longer be applicable in such circumstances.
However, the government has mandated that either parent notify the registration official within 30 days of the child obtaining foreign citizenship if the child later becomes a citizen of another nation while still living in India.
REVISED HOSPITAL REPORTING RULES
Additionally, the notification brings changes to administrative procedures and reporting requirements that apply to hospitals, nursing homes, and other medical facilities that offer lodging or sleeping accommodations on their property in addition to medical services.
The announcement changes reporting and compliance requirements under the Immigration and Foreigners Rules framework, but it does not significantly change the responsibilities of such organisations.
