Thane Citing the seriousness and brutality of the crime, a court in the Thane district of Maharashtra sentenced three men to life in prison in a mob lynching case where a man was beaten to death on suspicion of stealing.
The defendants, Ramtej alias Gavya Rama Yadav, Amarjeet alias Chabi Bindraprasad Gupta, and Chirag alias Kalya Shobhnath Thakur, were found guilty on Friday by Additional Sessions Judge V G Mohite of charges under sections 302, 323, and 504 of the Indian Penal Code.
The three were fined ₹10,000 apiece and given life sentences by the court.
It gave Shivkumar, also known as Lala Binder Lodh, the benefit of the doubt and cleared him of all allegations.
On March 6, 2021, a mob in the Indira Nagar neighborhood of Bhayander East attacked Surajbhan Omprakash Soni, the victim, and another individual, Vicky, also known as Abhishek Singh, on suspicion of stealing.
Soni died as a result of the assault, and a post-mortem determined that "intracranial haemorrhage and brain contusion" was the cause of death.
Ten prosecution witnesses were questioned to support the accusations against the accused, according to additional public prosecutor Rashmi Kshirsagar.
In its ruling, the court stated that the assault films demonstrated the seriousness and brutality of the crime.
The judge said that the arguments made on behalf of the accused were insufficient to demonstrate mercy, despite the fact that the accused are young offenders and their family members depend on them, the way in which the offense was committed must be taken into consideration while sentence.
"Imprisonment for life is the rule and death sentence is an exception," the judge stated.
The judge stated, "Death sentence must be imposed only when life imprisonment appears to be an inadequate punishment," concluding that the case did not fit into the category of extremely unusual cases.
